Terms of Service

1. Acceptance of Terms
By accessing or using the HeitechSoft HR Portal (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
These Terms constitute a legally binding agreement between you and HeitechSoft. We may modify these Terms at any time, and your continued use of the Services after such modifications constitutes acceptance of the updated Terms.
2. Eligibility
You must be at least 18 years of age and legally eligible to work in the applicable jurisdiction to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements.
3. Account Registration
To access certain features of our Services, you may need to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your login credentials confidential and secure
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
4. Acceptable Use
You agree not to:
- Provide false, misleading, or fraudulent information in your applications
- Impersonate any person or entity
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Services or servers
- Upload malicious code, viruses, or harmful content
- Harvest or collect information about other users
- Use automated systems to access the Services without our permission
5. User Content
You retain ownership of content you submit through our Services (resumes, cover letters, videos, etc.). By submitting content, you grant HeitechSoft a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing our Services and evaluating your applications.
You represent and warrant that you have the right to submit all content and that your content does not infringe any third-party rights.
6. Application Process
Submitting an application through our Services does not guarantee employment or an interview. HeitechSoft reserves the right to accept or reject any application at its sole discretion. We are an equal opportunity employer and do not discriminate based on protected characteristics.
7. Intellectual Property
The Services, including all content, features, and functionality (excluding user content), are owned by HeitechSoft and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
8. Third-Party Services
Our Services may contain links to or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEITECHSOFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.
11. Indemnification
You agree to indemnify, defend, and hold harmless HeitechSoft and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services or violation of these Terms.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination will remain in effect.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Ontario, Canada.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
